Copyright Infringement — DMCA Policy

Swivel Pty Ltd (“Swivel”, “we”, “our”, or “us”) respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for handling claims of copyright infringement in accordance with applicable laws, including the Digital Millennium Copyright Act (DMCA) for users located in the United States.

1. Scope of Policy

This policy applies to all content uploaded or submitted to the Swivel platform, including workspace photos, comments, documents, and any other user-generated content.

If you believe that content on Swivel infringes your copyright, you may notify us in writing by following the procedures below.

2. How to Submit a Takedown Notice

To file a copyright infringement notification with Swivel, please send a written communication that includes the following information:

  • Identification of the copyrighted work you believe has been infringed.
  • A description or direct link to the material on Swivel that you believe infringes your rights.
  • Your contact information, including your name, address, telephone number, and email.
  • A statement that:
    • You have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
    • The information provided is accurate, and under penalty of perjury, that you are the copyright owner or authorised to act on behalf of the copyright owner.
  • A physical or electronic signature of the person authorised to act on behalf of the copyright owner.

3. What Happens Next

Upon receiving a valid infringement notice:

  • We will promptly investigate the claim.
  • If the material is confirmed as infringing or we cannot verify the rights to it, we may remove or disable access to the content.
  • Where appropriate, we may notify the user who uploaded the material and provide them with a chance to respond (see Counter Notification process below).

4. Counter Notification Procedure

If you believe that the content removed or disabled is not infringing, or that you have the right to use the material, you may submit a counter-notification including:

  • Your name, contact information, and signature (physical or electronic).
  • Identification of the material and its location before removal.
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed due to mistake or misidentification.
  • A statement that you consent to the jurisdiction of the courts in your country (or Victoria, Australia, if outside a jurisdiction with applicable laws) and will accept service of process from the complaining party.

We may reinstate the content if we receive a valid counter notice, unless the original complainant seeks a court order to prevent this.

5. Repeat Infringers

Swivel may, at its discretion, restrict or terminate access to users who repeatedly infringe intellectual property rights.
